Terms and conditions

These conditions apply to all offers, orders and agreements between the customer and PorteVinho B.V. and to all actions to implement them. PorteVinho B.V. has the right at all times to change these conditions and the content of the website www.portevinho.be. If one or more provisions of these terms and conditions would be invalid, other provisions will remain in full force.

Age restriction

You must have the minimum legal age in the country of purchase to place an order with us. By placing an order through this website, you confirm that you are legally permitted to purchase alcoholic beverages. If you buy the alcoholic drinks as a gift, both you and the recipient must have the legal minimum age for alcohol consumption. If there is any doubt about the age of both the buyer and the recipient, our courier may request additional identification.

All rights are reserved. Nothing from this webpage may be copied, stored and / or distributed without prior written permission from PorteVinho B.V.

Disclaimer

The information on this website is for informative purposes only. All images; photographs, drawings etc.; ex data concerning weights, dimensions, colours, smells, flavours, images of labels, etc. on the PorteVinho internet site or approximate only, are indicative and cannot lead to compensation or dissolution of the agreement.

Delivery terms

Not all articles are always in stock. Delivery time estimates are approximations and not legally binding. Any delays caused by unforeseen circumstances can not lead to cancellation of the order, reimbursement or litigation.

Partial deliveries

If a certain product is temporarily unavailable, it is possible that an order will be shipped in parts. Incomplete orders If your order was delivered incompletely or damaged, we will take the necessary action to resolve this problem.

Warranty

Customers have the right to undo their purchase without question within 14 calendar days after delivery by contacting us within that timeframe. Within 14 business days after coming to an agreement, the product needs to be sent back in its original condition and packaging. The buyer will be reimbursed for the product if all conditions for correct shipping were met. Shipping costs are paid by the customer.

Liability

The seller is not liable to or responsible for any damage to the product outside of the aforementioned warranty.

Prices

The price at the moment of purchase will be used unless changes in VAT or shipping expenses and or sudden changes in currency values alter the price of the good. In that case, the seller will charge the updated price. The customer then has the right to cancel the order according to standard procedure.

Promotional prices

Promotional prices are only valid for a certain period and while stocks last. No claim can be made on the application of these prices before or after the specified period. Promotional prices are never cumulative with any other discounts or favorable conditions.

Failure to pay

Buyer will be charged a fine of 15% of the invoice total at a minimum of €25 if any amount remains unpaid after the due date. Furthermore an interest of 12% per year from the due date on to the date of payment will be charged.

Shipment to non EU-countries

If the shipping address is located outside of the EU then no Belgian VAT will be charged and the right documents will be added to ensure customs clearance. The buyer should be informed of any customs charges or VAT on import of alcoholic drinks. We are not responsible for customs seizure of goods. In this case we will try to resolve the process as soon as possible. In this case, it is possible that your contact information will be sent to local authorities or other authorities. We respect the right to privacy, but are not responsible for your contact information after it is sent to authorities. Please contact the customs office for more information in that case.

 

Shipping costs

The shipping costs depend on the weight of the order and the destination. This value is simulated in the shopping cart. The total of the shipping costs is calculated automatically when you place your order in the webshop. Please note that some factors of these calculations may vary and are subject to change without notice.

 

Shipping arranged by the buyer

The goods travel at the expense and risk of the buyer, if he organizes the transport himself. The seller has fulfilled his obligation to deliver when he delivers the goods to the carrier named by the buyer at the point as agreed. The transfer of costs and risks happens when the carrier accepts the goods.
